      LicenseesG must ensure that outsourcingG agreements comply with the CBB Law and the Personal Data Protection Law, issued on 19th July 2018.

      Licensees must ensure that the outsourcing providerG implements adequate safeguards and procedures.

    • GR-11.1.19

      The implementation of adequate safeguards and procedures would include the proper segregation of customer data from those belonging to other clients of the outsourcing providerG . Ancillary service providersG should have contractual rights to take action against the service provider in the event of a breach of confidentiality.

      Ancillary service providerG licensees must ensure that they retain title under any outsourcingG agreements for data, information and records that form part of the prudential records of the firm.
